ABQnews| Deutschland / Karlsruhe | Der Bundesgerichtshof (BGH) verkündet am Mittwoch (12.00 Uhr) ein Urteil zu den Geschäftsmodellen sogenannter Legal-Tech-Portale, die Verbrauchern im Internet die Durchsetzung ihrer Rechte anbieten. Konkret entscheidet der BGH darüber, ob das Angebot des Portals wenigermiete.de etwa zu Forderungen im Zusammenhang mit der Mietpreisbremse in seiner jetzigen Form zulässig ist. Das Urteil dürfte zentrale Bedeutung für die gesamte Legal-Tech-Branche haben. (Az. VIII ZR 285/18)
Portale wie wenigermiete.de setzen bei ihrem Angebot auf Technik. Die zentrale Idee ist, Standardfälle mithilfe von Softwareprogrammen zu bearbeiten. Zahlen müssen Kunden nur bei Erfolg. Rechtlich umstritten ist, ob die Anbieter als sogenannte Inkassounternehmen agieren können, die Forderungen eintreiben. Fraglich ist, ob es sich bei einem Legal-Tech-Portal wie wenigermiete.de überhaupt um ein solches Inkassounternehmen handelt oder ob es unerlaubte Rechtsberatung leistet.
